Pursuant to Section 51.901 of the Texas Government Code:


If a county clerk believes in good faith that a document filed with the county clerk to create a lien is fraudulent, the clerk shall:

  (1) request the assistance of the county or district attorney to determine whether the document is fraudulent before filing or recording the document;

  (2) request that the prospective filer provide to the county clerk additional supporting documentation; and

  (3) forward any additional documentation received to the county or district attorney.


Pursuant to Section 37.101 of the Texas Penal Code:

(a) A person commits an offense if the person knowingly presents for filing or causes to be presented for filing a financing statement that the person knows:

  (1) is forged;

  (2) contains a material false statement; or

  (3) is groundless.


(b) An offense under Subsection (a)(1) is a felony of the third degree, unless it is shown on the trial of the offense that the person had previously been convicted under this section on two or more occasions, in which event the offense is a felony of the second degree. An offense under Subsection (a)(2) or (a)(3) is a Class A misdemeanor, unless the person commits the offense with the intent to defraud or harm another, in which event the offense is a state jail felony.

Please call our office with your questions before you come to the Annex.  We will do our absolute best to help make sure we have the documents you looking for before you make an unnecessary trip.

Record search by the County Clerk or Deputy


In accordance with Government Code 51.318., there is a $5.00 fee per person for a record search which is performed by the County Clerk or a Deputy Clerk.


Request by mail


A record search requested through the mail must be accompanied by a written request, indicating the person’s name, the period of time to be searched and specific results, if any, needed for the search. In addition to a cashier’s check or money order, a self-addressed envelope must also accompany the request so that results may be returned.

There will be no telephone calls to verify the results of a search.




Copies of records may be purchased at $1.00 per page. Certified copies may be purchased at $5.00 for certification and $1.00 per page.

Section 254.0401, Election Code, is amended by adding Subsections (b), (e-1), and (h) to read as follows:

(b) The clerk or secretary of a political subdivision's governing body or, if the governing body does not have a clerk or secretary, the governing body's presiding officer shall make a report filed with the political subdivision by a candidate, officeholder, or specific-purpose committee under this subchapter available to the public on the political subdivision's Internet website not later than the 10th business day after the date the report is received. (e-1) Before making a report available on the Internet as required by Subsection (b), the authority with whom the report is filed may remove each portion, other than city, state, and zip code, of the address of a person listed as having made a political contribution to the person filing the report. The address information removed must remain available on the report maintained in the authority's office. (h) A report made available on an Internet website under this section must be accessible on that website until the fifth anniversary of the date the report is first made available.


The following provisions of the Election Code are repealed: (1) Sections 254.0401(a-1) and (c); and (2) Section 254.04011.


The changes in law made by this Act apply only to a report under Chapter 254, Election Code, that is required to be filed on or after the effective date of this Act. A report under that chapter that is required to be filed before the effective date of this Act is governed by the law in effect on the date the report is required to be filed, and the former law is continued in effect for that purpose.

This Act takes Effect September 1, 2023.
